This study examines the legal framework governing the personal liability of municipal officials for financial misconduct in South Africa. The study primarily focuses on the Municipal Financial Management Act 56 of 2003. It investigates how constitutional principles, legislative provisions, and case law collectively shape accountability mechanisms for unauthorised, irregular, fruitless, and wasteful expenditure by municipal managers, chief financial officers, and senior managers. Despite strong statutory mandates, practical enforcement remains meagre, hindered by political interference, procedural complexities, and institutional challenges. Through doctrinal legal analysis and case law review, the study identifies key bottlenecks in enforcing personal liability against municipal officials for financial misconduct and proposes targeted reforms to strengthen consequence management. The findings underscore the critical role of effectively enforcing the sanction of personal liability to safeguard municipal resources to promote fiscal discipline and sustainable service delivery in local government.
