Utilizing redundancy theory to explore the plausibility of conceptualising provincial intervention in municipalities as a constitutional override mechanism: South African case

| dc.description.abstract | Section 139 of the Constitution of South Africa empowers provincial and national governments to intervene when a municipality fails to fulfill an executive obligation in terms of the Constitution or legislation. Provincial intervention in failing municipalities has been conceptualized as a constitutional override mechanism to prevent the collapse of a municipality. However, this emerging conceptualization is yet to be explored to assess its plausibility. This paper utilized the redundancy theory and content analysis research methodology to explore the validity and reasonableness of conceptualizing provincial intervention as a constitutional override mechanism. The combination of theoretical grounding and deductive content analysis offered richer empirical descriptive and explanatory indicators to use in interrogating the validity and reasonableness of the conceptualization. This suggests that the elements of redundancy theory, such as backup, independence and substitutability, are intrinsically useful in explaining provincial intervention. Furthermore, deductive content analysis unearthed text from court judgements to establish the plausibility of the conceptualization of provincial intervention in failing municipalities as a constitutional override mechanism. | |
