Access to healthcare is essential for incarcerated individuals. Consequently, a strong population can greatly contribute to advancements. Nonetheless, marginalised groups, including those in prison, encounter barriers to obtaining these services. This mini-thesis sought to investigate the availability of healthcare for inmates with disabilities within South African correctional institutions. The author utilised desktop research to analyse data related to healthcare access for prison inmates. It explores the health rights of incarcerated persons as defined by international law and the methods used to guarantee that detainees can achieve the highest attainable standard of health. This mini-thesis analyses the right as defined by the United Nations and regional human rights frameworks, alongside the rulings of international human rights entities. It investigates the challenges encountered by prisoners with disabilities in correctional facilities. It also identifies the state’s legal duties to adhere to human rights standards as delineated in South African and international case law. To address these concerns, this mini-thesis employs a comprehensive approach to ascertain the highest possible standard of health. This encompasses an evaluation of sufficient standards for general healthcare, including preventive measures. It also investigates the degree to which the Constitution fully effectively safeguards access to health treatment for inmates with disabilities in South African prisons and assesses how well the provisions of the Correctional Services Act fully promote and support the right to medical care for disabled inmates in these facilities. Additionally, it considers what actions can be implemented to guarantee that prisoners with disabilities receive equal access to healthcare as other inmates while in correctional institutions.
