South Africa’s environmental governance framework, under Section 24 of the Constitution and operationalised through the National Environmental Management Act (NEMA), provides administrative enforcement tools aimed at ensuring environmental compliance. Despite progressive legislation, persistent non-compliance, particularly in water-related cases, raises concerns about enforcement effectiveness. This study evaluates the effectiveness of administrative enforcement tools: specifically, Section 28 Directives and Section 31L Compliance Notices in improving water and environmental management in the Western Cape Province. A mixed-methods approach was adopted, combining qualitative document analysis of 20 documents, 10 Investigation Reports and Enforcement Decisions (IR&EDs) and 10 Environmental Authorisations (EAs), with quantitative analysis of inspection and non-compliance trends from National Environmental Compliance and Enforcement Reports (NECERs). Administrative enforcement tools were effective in achieving corrective compliance in pollution-related cases; however, deterrence impact was constrained by limited follow-up, uneven monitoring, and weak integration with National Water Act (NWA) processes. Administrative enforcement contributes significantly to short-term remediation but requires strengthened institutional capacity, inter-agency coordination, and structured post-enforcement auditing to achieve long-term environmental compliance.
